This writ petition is filed to declare the action of respondents in not considering the petitioner for promotion as per seniority as a depot clerk, enquiry counter or any other suitable post in the existing vacancies along with his juniors as illegal, arbitrary and violation of principles of natural justice and discrimination and consequently direct the respondents to consider the petitioner for promotion as a depot clerk, enquiry counter or any other suitable post.

It is represented by learned counsel for the petitioner that the cause in the writ petition does not survive. 3.

Recording the said submission the writ petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
