THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1834 of 2018 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for the respondents. In spite of granting time on 24.01.2018, learned Government Pleader for Revenue did not get any instructions and this Court is constrained to dispose of the Writ Petition on the basis of averments made in the affidavit filed in support of the petition.

The petitioner states that he is a General Power of Attorney holder of the original owner Sri Mule Veera Reddy and the said General Power of Attorney was registered vide registered document bearing No.BK-1 of 2013, dated 29.04.2013, to act on his behalf. The original owner owned an extent of Ac.1-80 cents in Survey No.388/5, situated at Pamuru Village and Mandal, Prakasam District. He purchased the said land for valuable consideration under a registered document on 18.01.2010. After purchase, the revenue officials mutated his name in the revenue records and pattadar passbooks and title deeds were issued in his favour. While so, the said Veera Reddy paid a requisite fee for survey and requested the revenue authorities to conduct survey and fix the boundaries for the said land purchased by him. A notice was issued by the revenue officials to the neighbours on 02.09.2010 by fixing the date of survey on 10.09.2010, but no survey was conducted thereafter. In those circumstances, the present Writ Petition is filed. 3.

It is brought to the notice of this Court by learned Government Pleader for Revenue that notice was issued on 06.01.217 for

conducting survey on 09.01.2017 and the result of such survey is not known.

In the circumstances, if the survey was not completed by now, the fourth respondent shall complete the survey even in the absence of neighbours, for whom a notice was already issued, but, by issuing an appropriate final notice for conducting survey take necessary action in accordance with law, within a period of thirty (30) days from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________________ A.RAMALINGESWARA RAO, J FEBRUARY 05, 2018 YVL
