THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION NO.545 of 2015 ORDER:

Upon hearing the petitioner, at the admission stage, the Criminal Petition is disposed of as follows:

The submission of learned counsel for petitioner is that against the Judgment dated 05.09.2013 in D.V.C.No.18 of 2012 passed by the Court of Judicial I Class Magistrate, Bhainsa, he preferred Criminal Appeal No.103 of 2013 on the file of I Additional Sessions Judge, Adilabad and initially the said Court granted stay of the Judgment in D.V.C.No.18 of 2012, but, the said stay was cancelled by the Court on 25.09.2014 on the ground that no memo was filed for extension of stay. Now, the submission of the learned counsel is that the petitioner/appellant in order to show his bonafides will get ready in the Criminal Appeal and therefore, a direction may kindly be given to the Court of I Additional Sessions Judge, Adilabad, for disposal of the appeal at the earliest.

In the considered view of this Court, the said prayer appears to be a reasonable one. Hence, the learned I Additional Sessions Judge, Adilabad, is directed to dispose of the Criminal Appeal No.103 of 2013 within three months from the date of receipt of this Order and the stay earlier granted by him in Crl.M.P.No.245 of 2013 is extended till disposal of the Criminal Appeal. Both parties in the appeal shall cooperate with the Court in disposal of the appeal.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
