HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2240 of 2019 ORDER:
The grievance of the petitioners is that the revenue authorities and more particularly, the Tahsildar, Laxmidevipalli Mandal, Bhadradri-Kothagudem District, is not mutating their names in the revenue records in relation to the land admeasuring Acs.6.06 guntas in Survey No.150 of Chatakonda Village, Laxmidevipalli Mandal, Bhadradri-Kothagudem District. They seek a consequential direction to the Tahsildar to do so.
Perusal of the record reflects that the petitioners chose to make written representations to the various revenue authorities on 15.10.2018. Earlier they made similar requests in writing in September and October, 2017, followed by a reminder in January, 2018. Significantly, this is not the procedure prescribed for obtaining mutation in terms of the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. The petitioners would have to apply in Form-VI(A) along with the requisite fee for securing the relief sought by them. Without making an application in the prescribed format, it is not open to the petitioners to complain of inaction on the part of the revenue authorities even though they received their written representations.
The Writ Petition is accordingly disposed of permitting the petitioners to make an application in the prescribed format if they seek mutation of their names in the revenue records in relation to the subject land. If the petitioners make such an application and pay
the requisite fee, the Tahsildar, Laxmidevipalli Mandal, BhadradriKothagudem District, shall take appropriate action thereon expeditiously and in any event, not later than 45 days from the date of receipt of such application.
