THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.21407 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India challenging the inaction of the respondents in considering the representation made by the petitioner, dated 08-03-2016 for taking action against the President of the 4th respondent society for misappropriation of society funds .
2. The case of the petitioner is that he submitted a representation to the 3rd respondent alleging that unofficial respondent committed misappropriation of the society funds.
3. Whether the unofficial respondent committed misappropriation of society funds or not is purely a disputed question of fact, which cannot be gone into while exercising the jurisdiction under Article 226 of the Constitution of India. It is an admitted fact that for one reason or the other, the 3rd respondent has not disposed of the representation of the petitioner, dated 0803-2016.
4. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the 3rd respondent to dispose of the representation of the petitioner, dated 08-03-2016 in accordance with law within a period of two months from the date of receipt of a copy of this order.
