O R D E R

This writ petition was filed assailing the action of the Roads and Buildings Department of the State in trying to dispossess the petitioner from his house bearing house No.2-166 admeasuring 150 square yards situated at Satyalapadu Village, Gampalagudem Mandal, Krishna District.

The Assistant Engineer, Roads and Buildings Department, Thiruvuru Sub Division, Mylavaram Division, Krishna District, filed a counter-affidavit stating that the petitioner had no title over the subject property and that it was classified as road poramboke in the records. He however stated that any encroachments in the said land would be removed in accordance with law. In the light of the stand taken by the respondents in their counter-affidavit, the writ petition is disposed of leaving it open to the respondents to follow the due procedure laid down by law in the event they seek to interfere with the alleged possession of the petitioner over the subject property. Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs.
