THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 20937 OF 2010 O R D E R:

The Writ Petition is filed seeking a mandamus to declare the inaction on the part of the 2nd respondent in paying compensation to the petitioners in respect of their dry lands admeasuring Acs.2.00 in Survey No. 525/2 and Acs.2.00 in Survey No.530 respectively situated in Pamidipadu Village, Korisipadu Mandal, Prakasam District acquired for the purpose of construction of Yerram China Poli Reddy Lift Irrigation Tank, Korsipadu Village, Prakasam District, despite their representation dated 24.09.2009, as illegal and arbitrary.

Learned Government Pleader for Land Acquisition submits that the representation of the petitioners was considered and an Order has been made on 04.12.2010 itself refusing their claim for compensation.

Inasmuch as the Writ Petition is filed complaining inaction of the 2nd respondent Land Acquisition Officer only and now since the Order dated 04.12.2010 has been passed refusing the claim of the petitioners for payment of compensation, nothing survives in this Writ Petition for adjudication. Accordingly, it is dismissed. No costs.

However, it is open for the petitioners to challenge the Order dated 04.12.2010, if they are so advised.

Consequently, the miscellaneous Applications, if any shall also stand dismissed.
