HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 27314 of 2003 ORDER:

When the matter is taken up for hearing, none appears for the petitioner inspite of listing the matter under the caption 'for dismissal'.

A perusal of the record discloses that the petitioner is seeking compassionate appointment.

Learned Government Pleader for respondents contended that the case of the deceased employee was considered and the 1st son of the deceased employee was given compassionate appointment and the petitioner is the 2nd son who is not entitled. Therefore, he contends that there are no merits in the writ petition and is liable to be dismissed.

This Court, having considered the submissions made by the learned Government Pleader, is of the considered view that the respondents have already considered the case of the 1st son of the deceased employee and granted compassionate appointment and therefore, the question of considering the case of the petitioner, who is 2nd son of the deceased employee does not arise and the writ petition is liable to be dismissed as devoid of merits. Accordingly, the writ petition is dismissed.
