THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.2387 of 2019 ORDER:

The grievance of the petitioner is that the Tahsildar, Devaruppal Mandal, Jangaon District, is not taking action upon her representations dated 23.06.2018 and 25.06.2018 for issuance of a pattadar passbook and title deed in relation to the land admeasuring Acs.4.00 guntas in Survey No.1174/B of Chinnamadur Village, Devarauppal Mandal, Jangaon District.

It is the claim of the petitioner that the said land initially stood in the name of her husband and he gifted it to her under registered Document bearing No.3022 of 2017 dated 04.04.2017. Perusal of the record reflects that the petitioner's husband was issued a pattadar passbook in relation to this extent of land under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act of 1971'), and he thereafter gifted the land to his wife under a registered gift deed. It is however to be noted that the petitioner has to bring this change of ownership to the notice of the revenue authorities by making an application in Form VI(A) under the Act of 1971. However, she failed to do so and made written representations dated 23.06.2018 and 25.06.2018.

Without following the due procedure prescribed under the enactment, it is not open to the petitioner to complain of inaction on the part of the revenue authorities. The writ petition is accordingly disposed of permitting the petitioner to make an application in the prescribed format as per the Act of 1971.
