THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.24092 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for respondents.

The petitioner claims to be the owner of tractor bearing No.AP16 TW 3568. On 17.05.2015, when the tractor was engaged by one person for transportation of dry grass from Ootlapally Village to Naramvarigudem, after unloading the grass while returning to the village at 6.20 pm., the second respondent seized the tractor. When the said tractor was kept with the second respondent without issuing any show cause notice, the present writ petition is filed.

In spite of three adjournments, the learned Government Pleader could not get any instructions.

In the circumstances, the writ petition is disposed of directing the second respondent to inform the petitioner, if there is any crime registered against the petitioner, or otherwise release the tractor forthwith. It is needless to observe that if a crime is registered, the second respondent shall take necessary steps for production of the tractor before the competent court for taking further steps by the petitioner.

No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
