Sri V. Jagapathi, learned counsel for the sole appellant submits that though this appeal being AS No.1230 of 1994 and AS No.339 of 1995 in which also he is appearing as counsel for appellants, are listed as connected matters are in fact not connected matters and appeal AS No.339 of 1995 which is listed together with AS No.1230 of 1994, is to be heard separately.

As far as facts in this appeal i.e. AS No.1230 of 1994 are concerned, it is stated by learned counsel for the sole appellant that out of seven respondents, most of the respondents died and the appellant has not taken any steps to bring the LRs on record. It is to be seen that without brining the LRs of the deceased respondents, the appeal cannot be decided effectively. Hence, recording the submission made by the learned counsel for the appellant, this appeal is dismissed for not taking steps by the sole appellant to bring the LRs of the deceased respondents. Miscellaneous petitions, if any pending in this case shall also stand dismissed. There shall be no order as to costs. ____________________
