HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 3989 of 2009 Order:

This Writ Petition was filed challenging the demand notice issued by the fourth respondent vide letter No.1848/Q/2007 dated 07.01.2009 demanding stamp duty and registration fee at 5% on the bid amount and on security deposit as contrary to Article 31(a)(ii) of the Indian Stamp Act, 1899 and the Registration Act, 1908.

An identical issue when came up for consideration in W.P.No.23710 of 2008 and batch before a learned single Judge of this Court, the demand was upheld by order dated 19.11.2013.

In view of the detailed order passed in the said batch of cases, this Writ Petition is also dismissed upholding the demand following the order in W.P.No.23710 of 2008 and batch dated 19.11.2013. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
