THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY CONTEMPT CASE No. 278 OF 2019 ORDER:

This Contempt Case is filed alleging violation of orders dated 12.09.2018 passed by this Court in W.P.No.30094 of 2018.

By the above said order, this Court disposed of the writ petition recording the submissions of learned Standing Counsel that the BRS application filed by respondent Nos.3 and 4 is pending with them and the same will be disposed of strictly in accordance with law.

In compliance of the orders, the respondent corporation has disposed of the BRS application filed by respondent Nos.3 and 4 rejecting the application for regularization. Questioning the rejection action, respondent Nos.3 and 4 filed W.P.No.27238 of 2019 and obtained interim orders. This Court has granted orders directing the municipal authorities not to interfere with the possession of the petitioner.

However, Mr.K.Sidharth Rao, learned Standing Counsel appearing for the municipal corporation submitted that even before filing W.P.No.27238 of 2019 by the respondent Nos.3 and 4, they have partly removed the encroached portion of road

margin and they will take appropriate steps for removal of the entire structure after the disposal of the writ petition, which is pending on the file of this Court.

However, it is advised to the petitioner that he is entitled to implead in the pending writ petition and also entitled, to file fresh application seeking revival of the contempt case in accordance with law, if any cause survives.

Recording the said submissions, this Contempt Case is closed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this contempt case shall stand closed.
