HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.6446 of 2017 O R D E R:
The writ petition is filed challenging the action of respondents 2 to 4 in interfering with the civil disputes between the petitioner and the respondent Nos.5 and 6.
2. The 3rd respondent filed a counter affidavit, stating as follows: " ....It is pertinent to submit that as of now, no complaint whatsoever was received or registered against the petitioner herein on the file of Kollapur police station. I humbly submit that I did not summon the petitioner nor ask him to pay the alleged amount of rs.47,16,000/ - to the unofficial respondents herein. I humbly submit that the dispute of the petitioner as well as the 5th and 6th respondent herein is purely civil in nature and hence this respondent police is no way concerned with it. I humbly submit that this respondent never interfere with the civil disputes much less the dispute of the petitioner herein. This respondent personal enquiries revealed that as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint against him in future, the petitioner rushed to this Hon'ble court and filed the present writ petition with untenable allegations."
3. Learned counsel for the petitioner submits that he personally went to the police station and explained the civil dispute and in spite of it, the 3rd respondent threatened the petitioner.
4. Since the said allegation is denied by the 3rd respondent in the counter-affidavit, no further orders are passed in the present writ petition. Recording the same, the 3rd respondent is directed not to interfere with the civil disputes between the petitioner and respondent Nos.5 and 6.
5. The writ petition is, accordingly, closed. No order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
