This Criminal Petition is filed seeking quashment of proceedings in S.C.No.458 of 2018 on the file of the learned XIX Additional District & Sessions Judge, Miyapur, registered for the offence under Section 304-B of Indian Penal Code, against the petitioner/accused No.2.

Learned counsel for the petitioner as well as learned counsel for the respondent No.2 and learned Assistant Public Prosecutor are present.

Learned counsel for the petitioner submitted that the trial Court has already framed charges and trial has already been commenced and today the matter is coming for recording of evidence of prosecution witnesses.

The same is recorded.

In view of the above submission and considering the allegations levelled against the petitioner in the complaint, statements of witnesses recorded under Section 161 of Criminal Procedure Code including the charge sheet, this Court is of the opinion that since the trial has already been commenced today, at
this stage, there is no need to get into the question whether there is any prima-facie material against the petitioner or not. Therefore, the petitioner is at liberty to take all the defences which are taken in this Criminal Petition, before the trial Court. 06.
With the above observations, this Criminal Petition is closed. There is no order as to costs.
As a sequel, pending Miscellaneous Applications in this matter, if any, shall stand closed.
