THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18813 of 2017 ORDER:

Heard both sides. With the consent of both parties the writ petition is disposed of at the admission stage.

The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of respondents in seeking to evict the petitioner from the lands in Survey Nos.560/ 5/ 1, 560/ 7, 560/ 14, admeasuring Acs.3.26 guntas, Acs.9.10 guntas and Ac.1.00 guntas respectively, situated at Mallaram Village of Pinapaka Mandal of Bhadradri Kothagudem District pursuant to the orders passed by the second respondent in LTR Case No.79/ 2015/ PNK, dated 16.11.2016, pending disposal of the appeal filed before the first respondent, as illegal and arbitrary. 3.

Though various grounds are raised, learned counsel for the petitioner submits that the petitioner filed the appeal along with the stay application before the first respondent and that without disposing of the same, the respondent authorities are trying to evict the petitioner from the above said lands. 4.

Learned counsel appearing on behalf of the respondents would submit that the petitioner filed the appeal along with the stay application before the appellate authority, the same may be directed to be disposed of at the earliest. 5.

Having regard to the rival submissions made and without going into the merits of the case, the writ petition is disposed of directing the appellate authority to dispose of the stay application or appeal, filed by the petitioner, as early as possible preferably within a period of six weeks from today. Till such time, status quo as on today to be maintained. No costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed.
