THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN & THE HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.2231 of 2019 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) Mr. T. Vinod Kumar, learned special standing counsel takes notice.

2.

The petitioner has come up with the above writ petition challenging the urgent notice issued by the respondent demanding payment of the amounts due under orders of assessment passed in relation to the years 2011-2017 under the Telangana Tax on Entry of Goods into Local Areas Act, 2001. The reason as to why the petitioner had to come up with the writ petition was that as against the orders of assessment, the petitioner has already come up by way of writ petition and those writ petitions got tagged along with batch of cases in which the constitutional validity of the Act is in question. Though interim conditional orders were passed in other cases, there was no interim order in the batch of cases filed by the petitioner. Therefore, the urgent notice was issued forcing the petitioner to rush to this Court.

3.

Today, in the batch of writ petitions filed by the very same assessee against the orders of assessment, an interim conditional order has been passed. In the light of the above, the impugned urgent notice will automatically go, unless otherwise the interim conditional order passed in those writ petitions is not complied with. Therefore, with the above observations, the writ petition is disposed of putting on hold the urgent notice until the expiry of the period granted to the

petitioner for complying with the conditional order of stay in the batch of writ petitions.

Consequently, pending miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ V. RAMASUBRAMANIAN, J _______________ P. KESHAVA RAO, J February 7, 2019 DSK
