HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24521 OF 2017 ORDER:

The case of the petitioner is that he submitted application dated 28.06.2017 to the 3rd respondent for grant of licence in Form No.2B to run a bar and the same was forwarded to the 4th respondent for conducting enquiry with regard to the suitability of the premises. The 4th respondent in turn forwarded the said application to the Station House Officer, Vijayawada, Patamata and the SHO submitted a report on 13.07.2017 to the 4th respondent and the 4th respondent forwarded the said report to the 3rd respondent stating that the premises selected by the petitioner satisfies the conditions envisaged in the A.P.Excise (Grant of Licence of Selling by Bar and Conditions of Licence) Rules, 2017.

But, in view of the pendency of WP.No.18512/2017, no action has been taken by the 3rd respondent on the application of the petitioner. Aggrieved by the inaction of the respondents in not granting licence in Form No.2B, present writ petition is filed.

Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise. It is to be seen that in WP.MP.No.22589/2017 in WP.No.18512/2017, this Court only directed the respondents to consider the objections of the petitioners therein. There is no stay for grant of licence in the said writ petition. The petitioner

herein is also not a party to the said writ petition. As such, the application of the petitioner for grant of licence cannot be kept pending by the respondents without passing any orders. In view of the above, without expressing any opinion on merits, the writ petition is disposed of directing the respondents 3 and 4 to take appropriate action on the application of the petitioner for grant of Form 2B licence, after taking into account the objections filed by the objectors. No order as to costs.
