THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON NO.25537 OF 2000 ORDER:

This Writ Petition is filed seeking a Writ of Certiorari calling for the records relating to and connected with the impugned proceedings Rc.No.9712/C2-3/98 dated 1.8.2000 issued by the 3rd respondent wherein permission was accorded to appoint the 5th respondent as an Attender and quash or set aside the same and for a consequential direction to appoint the petitioner as an Attender in AP Residential School as per the written and oral test conducted on 12.6.1998. 2.

Heard Sri T.S. Anand, learned counsel for the petitioner and learned Government Pleader for the respondents. 3.

It is contended by the learned counsel for the petitioner that the 5th respondent had indulged in mal practice and he was de-barred from participating in the selection process to the post of Attender. 4.

Learned Government Pleader for the respondents submits that the 5th respondent filed writ petition No.35470 of 1998 before this Court and the said writ petition was allowed on 19.1.2000 directing the respondents therein to interview the petitioner within a period of four weeks from that day subject to his eligibility, suitability and other qualifications and consider his case for the post of Attender. In pursuance to the orders passed by this Court, the 5th respondent was considered and appointed as an Attender.

As the 5th respondent was appointed as an Attender in pursuance to the orders passed in writ petition No.35470 of 1998, I do not see any grounds to interfere with the impugned proceedings dt.1.8.2000. The age of the petitioner at the time of filing of this writ petition was 41 years and

as of now, the petitioner must be 58 years. At this belated stage, no direction can be issued to the respondents to appoint or consider the case of the petitioner for appointment to the post of Attender. Hence, Writ Petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
