THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20814 of 2007 ORDER:

This writ petition was filed by three small scale industries when they were not permitted to participate in the tenders called by the various municipalities in procuring various items manufactured by them particularly electrical items. They claim the benefit of G.O.Ms.No.48 dated 20.02.1999 and the AP Municipalities Tender Rules, 1967 and state that the respondents have to procure electrical items from small scale industries in accordance with the said Government Orders and the Rules. They further state that a learned single judge of this Court in W.P.No.21481 of 2003 dated 08.08.2007 considered an identical issue in the light of the said GO Ms.No.48 dated 20.02.1999 and allowed the writ petition wherein the Gram Panchayats were directed to consider the feasibility of purchasing the electrical goods only from the petitioner therein. 2.

Learned counsel appearing for the respondents submits that in view of the bifurcation of the State and in view of the changed circumstances, the GO Ms.No.48 dated 20.02.1999 does not apply as on today, but no counter affidavit is filed even after nine years by anyone of the respondents.

In the circumstances, the writ petition is disposed of directing the respondents to adhere to the policy framed by the Government

with regard to the purchase of goods produced by the small scale industries while procuring them through open tender or by placing the orders.

Writ petition is accordingly disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
