THE HONOURABLE MR JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.2655 of 2015

ORDER

Heard learned counsel for the petitioner, learned Government Pleader for Mines and Geology and learned Government Pleader for Revenue.

2. Petitioner, who represents the village, states that he is a resident of Jerripothulapalem Village, Pendurthi Mandal, Visakhapatnam District. It is stated that the Department of Forests under Social Forestry Scheme supplied saplings of cashew and mango trees to the petitioner and villagers and the same were planted in the allotted lands of about Ac.116.00 in Sy.No.75 of the same village in lieu of their lands, which were acquired for Meghadrigedda Reservoir. Alleging that the 4th respondent has granted quarry lease to the 8th respondent to an extent of Ac.25.00 in Sy.No.75, which will affect the cashew and mango trees of the petitioner and villagers, the petitioner stated to have made a representation dated 02.12.2013 to the 2nd respondent requesting him to cancel the quarry lease granted to the 8th respondent. Alleging inaction in disposing of the said representation, the present writ petition is filed.

3. In the prayer of the writ petition, it is evident that the petitioner seeks for cancellation of quarry lease granted to the 8th respondent. If the petitioner's grievance is against the said lease,

he has to approach the authorities under the Andhra Pradesh Minor Mineral Concession Rules, 1966, brining their notice the anomaly, if any, in granting the said quarry lease.

In that view of the matter, the Writ Petition is disposed of, directing the petitioner to make an appropriate representation before the 3rd respondent or any other competent authority under the Andhra Pradesh Minor Mineral Concession Rules, 1966, so as to enable the said authority to look into the said grievance and take appropriate steps. If such an application is received by the authority concerned, the same shall be examined and appropriate orders be passed after notice to the 8th respondent. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
