HONOURABLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL REVISION CASE No. 2537 OF 2012 ORDER:

This Criminal Revision Case is filed against the order dated 10.12.2012 passed in Crl.M.P.No.5098 of 2012 in Crime No. 308 of 2011 by the learned III Additional Judicial Magistrate of First Class, Rajahmundry, East Godavari

District.

The aforesaid criminal miscellaneous petition was filed by the Investigating Officer under Section 91 Cr.P.C. seeking to direct the Sub Registrar of Rajahmundry for production of thumb impressions register relating to the documents mentioned therein. The said petition was dismissed by the Court below through the order under revision. Aggrieved by the same, the defacto complainant filed the present criminal revision case. It is noticed that when the matter is pending investgation, the Investigating Officer filed the impugned application seeking the relief stated supra. Subsequently after disposal of the impugned application by the Court below and during the course of pendency of the present criminal revision case, investigation is completed and charge sheet has also been filed.

In view thereof, no further orders need be passed in the present criminal revision case. However, it is needless to mention that in view of the fact that investigation was completed and charge sheet has been filed, it is left open for the defacto complainant or the Prosecution to take appropriate steps as available under law for the relief sought for herein during the course of trial. With the above, the Criminal Revision case is dismissed. Miscellaneous petitions pending consideration if any in the Criminal Revision case shall stand closed in consequence. ------------------------------------ JUSTICE M.S.K.
