I.A.NO.2 OF 2021 Petition under Section 482 of Cr.P.C praying that in the circumstances stated in the grounds filed in support of the petition, the High Court may be pleased to direct the respondent to release the passport oflhe petitioner and to enable him to get updated with respect to his visa in the Ministry of Home Affairs Covernment of India and to visit his kith and Kin abroad for which the petitioner would be duty bound to cbmply the conditions that may be imposed and pray, pending disposal ofCRLP No. 840 of 2021, on the file ofthe High Court. The Court made the following
ORDER
Petitioner/A-l filed these two applications to relax the conditions imposed by this court by order dated 20.o4.2021 whereby tl:e petitioner was directed to appear before the investigating authorities on every saturday between 10.00 am and 5.00 pm till completion of investigation and submission of final report and that he shall surrender his passport before the court concerned and shall not leave the country without prior permission of the Court concerned, respectively.
Sri R. Ravi Kumar, learned counsel for the petitioner/A- l, submits that petitioner has been complying with the orders passed by this court as of now. It is further submitted that as per the directions of this court, he has surrendered his passport. The petitioner belongs to Yemen Republic and now his vlSA is expired and if the passport is returned, he can apply for extension of VISA.
As far as condition Nos.(ii) and (iii) are concerned, this Court is not inclined either .to release the petitioner's passport or to relax the condition of appearance before the investigating authorities, respectively. However, with the relevant details, the petitioner could move an application for return of passport before the Court concerned and the Court shall consider the same in accordance with law. Both the I.As. are ordered, accordingly.
