HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No. 2246 of 2020 ORDER:

This writ petition is filed for the following relief; "...to issue a writ, order or direction one in the nature of Mandamus declaring the inaction of the respondent Nos.2 & 3 in entering the schedule property i.e. land totally admeasuring Ac.19.27 guntas, (Ac.0.24 guntas in Sy.No.60, Ac.0.30 1⁄2 guntas in Sy.No.61, Ac.0.31 guntas in Sy.No.62, Ac.0.24 1⁄2 guntas in Sy.No.63, Ac.06.04 1⁄2 guntas in Sy.No.86, Ac.5.15 guntas in Sy.No.87 and Ac.5.17 guntas in Sy.No.88) situated at Shamshabad Village and Mandal, Ranga Reddy District in the prohibitory list of registration pursuant to the preliminary decree dt.25.09.2014 in OS.No.944/2007 on the file of XIII Addl.District and Sessions Judge, Ranga Reddy District at L.B.

Nagar as per the Standing Order 219(B) is illegal, arbitrary and unconstitutional and consequently direct the 2nd and 3rd respondents to forthwith enter the schedule property i.e. land totally admeasuring Ac.19.27 guntas, situated at Shamshabad Village and Mandal, Ranga Reddy District in prohibitory list of registration and be pleased to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." Heard both sides.

No provision of law is brought to the notice of this Court for granting relief sought by the petitioner in the writ petition. In fact, petitioner has alternate remedy of approaching Civil Court.

In view of the above, the writ petition is disposed of granting liberty to the petitioner to avail remedy as may be available to him under law. No order as to costs.
