THE HON'BLE SRI JUSTICE M. GANGA RAO WRIT PETITION No.10122 of 2002 O R D E R:

This writ petition is filed seeking the following relief: "to issue an appropriate writ, or order or direction more particularly in the nature of writ of Mandamus declaring the action of the respondents in not absorbing or issuing orders in grant-in-aid post in spite of accepting proposals or orders or admission of grant-in-aid post through G.O.Ms.No.365 Education dated 10.10.1984 and after issuing Memo No.42279-B/758/SMPC/1999 dated 29.11.2000 and not paying grant-in-aid salary even after working of the petitioner more than 14 years in same school is illegal, arbitrary and violation of Article 14 and other Government orders, consequently direct the respondents to absorb the petitionerteacher into grant-in-aid post by issuing necessary orders and to pay regular salary clearing all dues and pass such other order or orders may deem fit and proper."

The case of the petitioner is that he was appointed as Secondary Grade Teacher (un-aided post) on 15.8.1988 and his post was approved by the District Educational Officer, Mahabubnagar through proceedings No.C1/1214/96 dated 15.4.1997 with effect from 30.10.1996 and he was absorbed in grant-in-aid post by the management from 15.9.1998 in the existing post caused due to resignation of Smt. Sashikala, S.G.T. from 1.9.1998 in Adarsha Vidya Nilayam Charakonda, Mahabubnagar District.

Accordingly, proposals were submitted by the Mandal Educational Officer, M.P., Wanqoor

to the District Educational officer, Mahabubnagar, for absorption of the petitioner. The District Educational officer, Mahabubnagar through Letter Rc.No.C1/9645/99 dated 14.08.1999 submitted proposals to the Commissioner & Director of School Education, Hyderabad, to issue orders absorbing the petitioner into aided post from 1.9.1998 in terms of G.O.Ms.No.275 Finance and Planning Department, dated 11.12.1995 and the Commissioner in turn submitted proposals to the Government for necessary orders. The Government issued orders approving the appointment of the petitioner into grant-in-aid post in Adarsha Vidya Nilayam, Charakonda through Memo dated 29.11.2000.

The petitioner submits that he has been working in the same school for the past 13 years and he submitted several representations but so far no approval orders were received from the Government. Aggrieved by the same, the present writ petition is filed. In pursuance of the interim directions of this Court passed on 24.9.2002 in WPMP.No.12424 of 2002, the petitioner's case was considered and absorbed in grant-in-aid service from 11.9.2000 as Secondary Grade Teacher at Adarsha Vidyalayam Charakonda (Aided) and he retired from service on attaining the age of superannuation on 31.5.2017 and he is receiving regular pension.

In view of the compliance of the interim orders of this Court, no further orders are necessary in the writ petition.

Accordingly, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
