THE HON'BLE SRI JUSTICE SANJAY KUMAR CONTEMPT CASE No.2143 of 2012 ORDER:

This Contempt Case was instituted alleging deliberate violation of the order dated 18.09.2012 passed by this Court in Writ Petition No.28372 of 2012.

By the said order, the Writ Petition was disposed of directing the Station House Officer, Kalla Police Station, Kalla Village and Mandal, West Godavari District, to complete the investigation in Crime No.76 of 2012 on the file of Kalla Police Station, West Godavari, and file a report as contemplated under Section 173 Cr.P.C. as expeditiously as possible and preferably within two months from the date of receipt of a copy of the order.

The Sub-Inspector of Police, Kalla Police Station, West Godavari District, filed a counter-affidavit stating that upon due investigation in Crime No.76 of 2012, which was registered under Sections 447, 324 and 506 IPC read with Section 34 IPC, a final report was filed before the competent criminal Court under Section 173 Cr.P.C. referring the case as 'mistake of fact'. The said final report was stated to have been filed on 22.02.2013 before the learned II Additional Judicial I Class Magistrate, Bhimavaram. Intimation was said to have been given to the complainant under S.R.No.1181 of 2013.

In the light of the afore-stated facts, it is clear that the direction of this Court in Writ Petition No.28372 of 2012 has been duly

complied with, albeit with some delay. However, this Court is not inclined to take a serious view in the matter since there was no positive direction as regards the timeframe.
