This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.1 seeking his enlargement on bail in connection with FIR No.6 of 2026 of Panjagutta Police Station, Hyderabad. The offences alleged against the petitioner are under Sections 126(2), 79 of Bharatiya Nyaya Sanhita (for short 'BNS') and under Section 11 r/w.12 of POCSO Act, 2012.

The case of the prosecution is that the defacto complainant lodged a complaint on 04.01.2026, stating that she

- 2 - is studying 10th Class and on the same day after completion of her school at about 5:30 PM, she went to PVR Mall, Erramanzil. While returning towards Erramanzil Metro Station, a male person aged about 20-22 years, wearing a face mask, approached her and her friend (Victim-2) on a two-wheeler bearing No. AP 31 1894. He appeared nervous and sweating. He stopped them and said that his elder brother's daughter was facing a health issue and asked for advice. They told him to provide sanitary pads and take her to a hospital. However, he ignored their advice and began asking inappropriate and obscene questions. Despite their repeated advice to take the girl to a hospital, he continued his questions making them feel uncomfortable. Feeling frightened and suspecting danger, they rushed to the Police Station and lodged a complaint. Hence, requested to take necessary action against the accused. Basing on the said complaint police registered the case against the accused for the above offences.

Heard Sri Syed Hameed, learned counsel appearing for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that petitioner is innocent of the said allegations and he is in jail from 07.01.2026 and material part of investigation is already completed. Petitioner is working as Superintendent in Mission Bhagiratha Project and there are no other cases pending against him. Hence, prayed this Court to grant regular bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegation against the petitioner is heinous in nature. Being a responsible government officer, he misbehaved with the minor children. Therefore, petitioner is not entitled for bail and prayed to dismiss this petition. 6.

Considering the submissions made and a perusal of material on record, petitioner is in jail from 07.01.2026 and as seen from the record Lws.1 to 16 are examined. Considering the period of incarceration of petitioner in jail and the facts and circumstances, the petitioner is granted regular bail subject to the following conditions :

i. The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of Special Judge for Trial of Cases under Protection of Children from Sexual

- 4 - Offences (POCSO)-cum-XII Additional Sessions Judge, Hyderabad.

ii. The petitioner/Accused shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Wednesday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii. The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of the BNSS. 7.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
