JUSTI CE ANI S WRI T PETI TI ON Nos. 1919 and 1920 of 2017 COMMON ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) These writ petitions were filed seeking implementation of the common order dated 12.09.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.Nos. 7259 of 2013 and 7765 of 2013. The petitioner in W.P.No.1919 of 2017 is the applicant in O.A.No.7259 of 2013 while the petitioner in W.P.No.1920 of 2017 is the applicant in O.A.No.7765 of 2013. By the common order dated 12.09.2016, the Tribunal allowed the O.As. setting aside the Memo dated 24.03.2012 and the consequential notice dated 09.07.2013 but granted liberty to the District Collector, Karimnagar i.e., the Disciplinary Authority, to pass final orders on the basis of the enquiry report dated 28.02.

2012 in accordance with the rules. The Disciplinary Authority was also directed to take into consideration the fact that the charges against one Krishna Reddy were dropped by the Government vide G.O.Rt.No.915 dated 13.06.2011 and the fact that the Mandal Revenue Officer who issued the certificate had also retired from service and his pensionary benefits were sanctioned without any penalty being imposed upon him. This exercise was directed to be completed within two months from the date of receipt of a copy of the order.

Learned Government Pleader for Services (Telangana) concedes that no writ petitions were filed by the authorities in relation to the aforestated common order.

That being so, this Court is of the opinion that it is not open to the authorities to fail to abide by the order passed by the Tribunal; all the more so, when the Tribunal also fixed a time stipulation. The Writ Petitions are accordingly disposed of directing the respondents to abide by and implement the common order dated 12.09.2016 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.Nos. 7259 of 2013 and 7765 of 2013. As the time frame fixed by the Tribunal has already expired, the exercise shall be completed within two months from the date of receipt of a copy of this order.
