HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 29118 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner is a Fair Price Shop Dealer to Shop No. 7 of A.Narayanapuram village of Ananthapuram Rural Mandal, Ananthapuram District. The authorization of the petitioner was suspended by the third respondent through proceedings dated 12.2.2015 and questioning the same, the petitioner filed Writ Petition No. 4571 of 2015. This Court disposed of the said Writ Petition by order dated 06.03.2015 directing the third respondent to conduct an enquiry and pass final order within two months. Thereafter, though the petitioner submitted her explanation, the third respondent cancelled the authorization of the petitioner through proceedings dated 12.06.2015. Challenging the same,

the petitioner preferred an appeal to the second respondent and the said appeal was dismissed on 10.08.2015. Against the said order, the present Writ Petition is filed.

As many as ten charges are levelled against the petitioner and the second and third respondents considered the case of the petitioner at primary and appellate stages respectively. Against the dismissal of the appeal preferred by the petitioner, alternative remedy of statutory revision is available and in that view of the matter, this Court is not inclined to go into merits or otherwise of the charges levelled against the petitioner and findings recorded thereon.

In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to prefer a revision to the competent authority against the order dated 10.08.2015 passed by the second respondent within a period of fifteen days from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
