10. 13.03.2024 Dr.GRR, J I.A.No.2 of 2024 In I.A.No.1 of 2024 In I.A.No.1 of 2023 In Crl.P.Nos.907, 915 and 916 of 2023 These applications are filed by the petitioner - Accused No.1 to extend the time granted by this Court vide common order dated 20.02.2024 in I.A.No.1 of 2024 in I.A.No.1 of 2023 in Crl.P.Nos.907, 915 and 916 of 2023 to return to India from 20.03.2024 to 20.05.2024.

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor for the respondent - State. Learned counsel for the petitioner submitted this Court relaxed the condition No.(i) in I.A.No.1 of 2023 directing the petitioner to return to India on or before 20.03.2024. On receiving the order passed by this Court, the petitioner sent the scanned copies of the copy of his passport to his daughters for causing enquiry with Immigration Authorities as to the time line for grant of VISA to visit India again as per the Orders of this Court and was informed by his daughters on 05.03.2024 that for taking VISA to visit India, a citizen of USA has to stay minimum of two (02) months. As such, the petitioner could not take travel to USA for obtaining extension of VISA. The time granted by this Court to return to India on or before 20.03.2024 may be extended for two months to enable him to get VISA to visit India.

-2He further submitted that if the petitioner failed to get extension of VISA from US Immigration Department, the stay of the petitioner in India would be treated as unauthorized. Learned Assistant Public Prosecutor reported no objection for extending the time.

Considering the submissions of the learned counsel for the petitioner, it is considered fit to extend the time granted by this Court in I.A.No.1 of 2024 in I.A.No.1 of 2023 in Crl.P.Nos.907, 915 and 916 of 2023 from 20.03.2024 to 20.05.2024.

Accordingly, I.A.Nos.2 of 2024 in I.A.Nos.1 of 2024 in I.A.Nos.1 of 2023 in Crl.P.Nos.907, 915 and 916 are allowed extending the time from 20.03.2024 to 20.05.2024 as prayed for.
