THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.1039 OF 2024 O R D E R:

This Criminal Petition is filed under Section 438 of Code of Criminal Procedure (for short 'Cr.P.C.') by the petitioners/Accused Nos.2 to 7 seeking bail in the event of their arrest in connection with Crime No.164 of 2023 on the file of Inavolu Police Station, Warangal District, registered for the offences under Sections 294B, 323, 324, 326 and 506 r/w. 34 of IPC. 2.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State. Perused the record.

On 03.11.2023, a telugu written complaint was filed alleging that A-1 and these petitioners have trespassed and attacked the de-facto complainant and family members. It appears that the disputes with regard to construction of a house illegally in the premises resulted in altercation. Injuries were received on both sides and case and counter cases were filed.

Keeping in view that both the parties have entered into altercation resulting in injuries and case and counters cases were filed, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos.2 to 7 are directed to surrender before the Station House Officer, Inavolu Police Station, Warangal, on or before 07.02.2024. Upon such surrender, the said Station House Officer shall release the petitioners/Accused on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, for a like sum each to his satisfaction.

2) On such release, the petitioners/Accused Nos.2 to 7 shall appear before the concerned Station House Officer as and when required for the purpose of investigation.

3) The petitioners/Accused Nos.2 to 7 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
