HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5921 of 2016 ORDER:

This petition is filed by the petitioners - Accused Nos.1 and 2 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail to them in Crime No.4 of 2016 on the file of K.D. Peta Police Station, Visakhapatnam District, registered for the offence punishable under Section 20(b) of the NDPS Act.

Heard and perused the material available on record. It is alleged that the petitioners were found in possession of 70 kgs of ganja.

The learned Public Prosecutor submitted that charge sheet has already been filed in the above crime.

Since the quantity of ganja found in possession of the petitioners is commercial, this Court is not inclined to grant the relief sought by them. However, the trial Court is directed to complete the trial within a period of two months from the date of receipt of a copy of this order. If the trial is not completed within the time stipulated, the petitioners are directed to file a fresh application.
