THE HON'BLE SRI JUSTICE A.V.SESHA SAI W.P.No.22245 of 2015 O R D E R:
This writ petition is filed under Article 226 of the Constitution of India for the following relief - " For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent police in harassing the petitioners to come and attend before the 2nd respondent police every day and without following due process of law and harassing the petitioners in one way or the other way and also disturbed the petitioners day to day life at the time of Eid as illegal, arbitrary and against the principles of natural justice and consequently direct the 2nd respondent police not to harass the petitioners by calling the petitioners to their police station frequently and pass such other order or orders as the Hon'ble Court may deem fit and proper in the interest of justice and circumstances of the case."
A counter affidavit has been filed by the Inspector of Police, P.S. Panjagutta, Hyderabad and in para 14 of the counter, it is stated as follows : " It is respectfully submitted that the contention of the petitioners that the 2nd respondent police harassed the petitioners to come and attend before the 2nd respondent police every day and disturbed the petitioners day to day life at the time of Eid is false, hence denied. It is submitted that except registering the above FIR against the petitioners and investigating the case herein the respondent police never harassed, threatened and interfered with the life and liberty of the petitioners herein at any point of time."
Noticing the same, learned counsel for the petitioners requests the Court to dispose of the writ petition by recording the above averments made in para 14 of the counter affidavit. In view of the above, the writ petition stands disposed of by recording the averments made in para 14 of the counter affidavit filed by the Inspector of Police, P.S. Punjagutta, Hyderabad. Miscellaneous applications, if any pending in the writ petition, shall stand closed. No costs.
