O R D E R

This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.11 seeking to enlarge him on bail in connection with C.O.R.No.72 of 2025 of Prohibition & Excise Station, Dhoolpet, Hyderabad. The offence alleged against the petitioner is punishable under Section 8 (c) read with 20 (b)(ii) (C) of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

The case of the prosecution is that on 01.08.2025 at 09:00 AM on reliable information about illegal transportation of ganja on the road leading from Jiyaguda Kamela to Puranapool Bridge, they conducted search, wherein accused Nos.1 and 2 were found in possession of 21.425 kgs of dry Ganja. The same was

- 2 - seized and reported to police, who in turn registered a case against the accused persons for the aforesaid offence. 3.

Heard Sri Gulab Singh, learned counsel for the petitioner/A.11 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that the petitioner is arrayed accused No.11 in the aforesaid crime. The petitioner has been in judicial custody since 10.12.2025. He further contended that though said dry ganja was not seized from the possession of the petitioner, he has been falsely implicated in the present case. Even according to the prosecution case the petitioner 5 kgs., of ganja from accused Nos.1 and 2 and there are no other cases pending against the petitioner. He further submits that Accused Nos.1 and 2 were already released from jail and hence, he prays to grant regular bail to the petitioner-accused No.11.

On the other hand, the learned Additional Public Prosecutor opposed the same and submits that the offence registered against the petitioner is under NDPS Act and seized quantity of ganja would be 21.425 kgs., which is a commercial quantity. Therefore, at this stage, the petitioner herein is not entitled to grant bail and hence, he prays to dismiss the Criminal Petition.

- 3 - the allegations made these petitioners are serious in nature; that the petitioners are habitual offenders; that previous cases are pending against them, as such they are not entitled for grant of bail and hence, he prays to dismiss the criminal petition. 6.

Considering the submissions made by learned counsel on either side and on perusal of the entire material on record, the petitioner is in judicial custody since 10.12.2025 and most part of the investigation is completed. The only allegation against the petitioner is that he purchased 5 kgs., of ganja from accused Nos.1 and 2. Further, accused Nos.1 and 2 were already granted bail. Considering the allegation made against the petitioner/accused No.11, this Court opines that it is appropriate to grant regular bail to the petitioner, subject to the following conditions: (i) The petitioner-accused No.11 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional Chief Judicial Magistrate, Hyderabad.

(ii) On such release, the petitioner-accused No.11 shall appear before the concerned SHO at 11:00 a.m., on every Monday and Friday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

- 4 - (iii) The petitioner-accused No.11 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
