Heard counsel for petitioner and Government Pleader for Home appearing for respondents.

Petitioner's allegation is that petitioner's vehicle bearing Registration No.AP TS 09 BD TR 7685 belonging to him has been detained illegally by the 5th respondent on the ground that driver of the said vehicle was drunk.

The Government Pleader for Home appearing for respondents states that the vehicle was seized on 08.12.2018 as the driver was not in a position to drive the vehicle and so the vehicle was detained.

Even if the driver on that particular day was unable to drive the vehicle, that does not mean that respondents can retain the vehicle.

Therefore, the petitioner is directed to appear before the 5th respondent with RC Book relating to the said vehicle and also by producing proof of his identity and thereupon the 5th respondent or other official, who has the custody of the vehicle in question, shall release the said vehicle to the petitioner forthwith. 6.
The Writ Petition is accordingly disposed of. No order as to costs.

Consequently, Miscellaneous Petitions pending if any, shall stand closed.
