THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.14431 of 2009 ORDER:

No representation for petitioner.

The petitioner complains against action of 1st respondent in considering the seniority of petitioner for promotion to the post of Senior Assistant, as illegal, arbitrary and unconstitutional. On 29-10-2009 in W.P.M.P.No.18924 of 2009, this court directed the respondents as follows:- "No counter affidavit is filed on behalf of the respondents so far.

There shall be a direction to the 1st respondent to consider the petitioner's representation dated 11-06-2009 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of this order." This court is of the view that if the representation is considered and disposed of, the disposal gives fresh cause of action and the petitioner has to work out the remedies independently against such disposal. In the alternative, if the representation remains unattended as on date, in spite of the direction of this Court, this court is satisfied that the interim order dated 29-10-2009 can be made final order and 1st respondent shall pass orders on the representation dated 11-06-2009 within four weeks from the date of receipt of a copy of this order. The writ petition is disposed of as indicated above. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
