HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL REVISION PETITION No.3396 of 2002 ORDER:

This revision is preferred challenging order dated 15.12.2000 in E.P.No.92 of 1997 in O.S.No. 69 of 1987.

2. Respondent herein filed E.P.No.92 of 1997 after appeal filed by him challenging decree in O.S.No.69 of 1987 was allowed. Trial Court closed the E.P. by making attachment absolute in view of the stay granted in the Second Appeal preferred by revision petitioner herein. 3 . Now it is represented that this Court allowed the Second Appeal No.868 of 1997 on 14.11.2011 restoring original decree passed in O.S.No.69 of 1987. So, in view of the judgment in Second Appeal No.868 of 1997, there may not be any hurdle for petitioners herein, who are decree holders in O.S.No.69 of 1987 for withdrawing the attached amount.

4. So, in view of judgment in Second Appeal No.868 of 1997, the cause in this Civil Revision Petition does not survive. 5 . Accordingly, the Civil Revision Petition is disposed of. No costs.
