HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.1839 of 2018 ORDER:
Heard learned counsel for the petitioners and also learned Government Pleader for Prohibition & Excise for respondents and perused the prayer in the writ petition with the supporting affidavit and other material on record.
The prayer in the writ petition reads as follows: "To issue a writ, order or direction particularly one in the nature of writ of mandamus declaring the inaction of the respondents in considering the application of the petitioners society dated 14.12.2017 submitted on 23.12.2017 for revival of licence as per Rule 39 of the A.P. Excise (Grant of licence to sell toddy, conditions of licence tapping of Excise Trees) Rules 2007 as illegal, without jurisdiction, violative of Article 14, 19(1)(g) and 21 of the Constitution of India and consequently direct the respondents to consider the application of the petitioner society dated 23.12.2017 for revival as per Rule 39 of the A.P.
Excise (Grant of licence to sell toddy, conditions of licence tapping of Excise Trees) Rules 2007 forthwith and pass such other and further orders in the interest of justice." It is the submission of the learned Government Pleader that the authorities have no objection to consider the application on own merits as contemplated by Rule 39 of the A.P. Excise Rules 2007.
(04) weeks from the date of receipt of this order on own merits. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
