HON'BLE SRI JUSTICE S.V. BHATT W.P. No.12530 OF 2016 ORDER:

The petitioner prays for the following relief: "...Writ of Mandamus declaring the action of the respondents in interfering into the peaceful possession and enjoyment of the land survey No. 235/3 extent Ac 4.88 cents situated at Lam village, Tadikonda mandal, Guntur District without issuing any notice and following due process of law as arbitrary and illegal, violative of Articles 14, 19 and 300A of the Constitution of India consequently direct the respondents not to interfere without issuing any and without following due process of law..."

The 4th respondent filed counter affidavit setting out in detail the totality of circumstances, however, has stated that the respondents do not intend to interfere with the petitioner' possession except in accordance with law. As the learned counsel requests the Court to dispose of the writ petition by accepting the statement made in the counter affidavit, the operative portion is excerpted:

"In the light of the above facts and circumstances, it is finally submitted that the respondents did not interfere with the lands of petitioner's daughter and shall not interfere with the land in S.No.235/3 of Lam Village for an extent of Ac.4-88 cents without following due process of law."

The statement is placed on record and the writ petition is disposed of. No order as to costs.
