HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.2557 OF 2017 ORDER:

The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Code'), is filed requesting to quash the proceedings in C.C.No.249 of 2013 on the file of Judicial Magistrate of First Class, Mahabubnagar, against the petitioner.

2. The petitioner is arraigned as accused No.13 in the aforesaid Calendar Case. She, along with others, who are not parties to the present Criminal Petition, alleged to have committed the offences punishable under Section 498A I.P.C. and Sections 4 and 6 of Dowry Prohibition Act, 1961.

3. Heard Sri S. Sreenivas, learned counsel for the petitioner.

4. Learned counsel for the petitioner would now restrict the relief to the extent of dispensing with the appearance of petitioner during trial of the aforesaid Calendar Case, on the ground that the petitioner is prosecuting studies and it would be inconvenient for her to attend the Court.

5. The request appears to be reasonable. Therefore, acceding to the request, the present Criminal Petition is disposed of dispensing with the appearance of petitioner herein viz., Manju @ Madhavi Latha, during trial of C.C.No.249 of 2013 on the file of learned Judicial Magistrate of First Class, Mahabubnagar, but, however, she is

ASN,J Crl.P.No.2557 of 2017 directed to appear as and when the Court below takes up examination under Section 239 of the Code and under Section 313 of the Code, and also on other occasions where the learned Magistrate opines that her presence is absolutely necessary.

6. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
