THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.19463 of 2014 ORDER:

There is no representation on behalf of the petitioner. 2.

The prayer sought in the writ petition is as under:- "...to issue any Writ, order or direction more particularly one in the nature of Writ of Mandamus directing the Respondents 1 & 2 herein not to interfere in civil matters, consequently direct the 1st Respondent to initiate action against 2nd Respondent herein for his high handed behaviour with the petitioner parents and to pass such order or other orders as this Hon'ble Court may deem fit and proper in the interest of justice." 3.

Respondent No.2 filed a counter-affidavit denying the allegations made in the affidavit filed in support of the writ petition and contended inter alia that respondent No.2 never harassed, threatened and interfered in the civil disputes between the petitioner and respondent Nos.3 and 4. It is also denied that respondent No.2 refused to receive the complaint lodged by the petitioner and on the other hand, threatened the petitioner to implicate him in cheating case. On 08.07.2014 the police constable of Subedari Police Station never went to the house of the petitioner and summoned his father and they never detained him in the Police Station. It is also mentioned in the counter-affidavit that after going through the contents of the affidavit, it appears that there is a civil dispute between the petitioner and respondent Nos.3 and 4, for which the respondent police has nothing

to do with it. The petitioner is unnecessarily involving the respondent police into civil litigation.

Though counter affidavit is filed, no reply affidavit is filed to rebut the averments made in the counter-affidavit. 5.

In view of the same, this Court is of the opinion that there are no merits in the writ petition and the same is liable to be dismissed. 6.

Accordingly, the writ petition is dismissed.

As a sequel, miscellaneous petitions pending, if any, shall stand dismissed. No costs.
