HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 34593 of 2016 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Revenue. With the consent of both the parties, the writ petition being heard at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the third respondent in not passing any order or not posting the petitioners' appeal bearing No.F2/ 4224/ 2016 which was filed on 24.08.2016 against the order dated 29.07.2016 in Proceedings No.B/ 1500/ 2015 of the fourth respondent, as arbitrary, illegal and contrary to law. Though various grounds are raised in the writ petition, the grievance of the petitioners is that though the appeal was filed on 24.08.2016 till date no orders passed in the main appeal or in the stay application.
The Government Pleader for Revenue submits that a direction may be issued for an early disposal of the appeal. Without going into the merits of the case and having regard to the arguments advanced, the present writ petition is disposed of, directing the third respondent to dispose of the appeal bearing No.F2/ 4224/ 2016 or pass orders on the stay application filed along with the appeal, after hearing all the concerned including the petitioners, in accordance with law, as expeditiously as possible, preferably, within a period of twelve (12) weeks from the date of
receipt of a copy of the order. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
