HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.25761 OF 2008 ORDER: (Per Hon'ble Sri Justice V. Ramasubramanian) This is a petition filed by a voluntary organization seeking a mandamus to declare the action of the 1st respondent Devasthanam in inviting tenders for the grant of license to maintain Kalyana Mandapams.

2. It is seen from the affidavit in support of the writ petition that the respondent Devasthanam invited religious minded and pious people to donate lands of the extent of not less than one acre for the purpose of constructing Kalyana Mandapams. The Devasthanam also undertook to invest not less than 50% of the cost of the construction. Several persons donated the land or money, with which the respondent Devasthanam constructed Kalyana Mandapams. After completion of construction, the Devasthanam issued public notices inviting tenders for the grant of license to let out the Kalyana Mandapams, maintain it and collect money. Aggrieved by the notification so issued, a batch of writ petitions was filed. When these writ petitions are pending, a fresh notification was issued on

05-11-2008. Challenging the second notification, this writ petition has been filed.

3. By separate orders, we have today dismissed the other writ petitions, which led to the notification, dated 0511-2008 impugned in this writ petition. The present writ petition also deserves to meet with the same fate.

4. The grievance of the petitioner as projected in their affidavit is that the Kalyana Mandapams constructed from out of the donations received for religious purposes, if handed over to private individuals, they may be misused for unlawful objects and purposes. But such a grievance is actually presumptuous. Even before the auction is over, it cannot be presumed that persons, who participated in the auction, will have an intention of putting the property to a wrongful use. Hence, the writ petition is devoid of merits and accordingly it is dismissed. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this writ petition, shall stand closed. __________________________ V.
