THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 27635 OF 2017 O R D E R:
This Writ Petition has been filed seeking a mandamus to declare the action of the 2nd respondent in interfering with the liberty of the petitioner by calling him to the police station, at the instance of the 3rd respondent, without registering any crime and directing him to settle the disputes with the latter, as illegal and arbitrary.
Heard learned counsel for the petitioner.
Learned Government Pleader for Home (Telangana) secured written instructions from the Sub-Inspector of Police, Rajendranagar Police Station and submits that the son of the 3rd respondent herein lodged a complaint on 25.07.2017 against the petitioner which was registered as a case in Crime No. 1544 of 2017 for the offences punishable under Sections 406 and 420 of the Indian Penal Code on the same day itself and investigation has been taken up. Thereafter, to divert the attention of the Investigating Agency, the petitioner has come up with this Writ Petition, is what the learned Government Pleader submits. Recording the written instructions issued by the SubInspector of Police specifically stating that to escape investigation at the hands of the police, the petitioner has approached this Court, this Writ Petition is closed. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
