THE HON'BLE SRI JUSTICE S.V.BHATT C.R.P. No.362 of 2018 ORDER:

Heard Mr.I.Gopal Reddy, for petitioner.

The plaintiff in O.S.No.01 of 2007 is the revision petitioner. The revision petitioner at the stage of reply arguments filed four (04) independent applications for payers such as reopen, recall, leave etc., I.A.No.494 of 2017 is filed under Order 7 Rule 14(3) of CPC seeking leave of the Court to file the documents stated in the petition. The respondents herein opposed the application.

The trial Court has taken note of each one of the circumstances including the abnormal delay in filing an application for leave to file documents and also that such an attempt is undertaken when the suit was coming for reply arguments of petitioner herein.

The trial court both for the reasons stated in the affidavit and the time at which the request is made declined to exercise its discretion, this Court is in complete agreement with the findings recorded by the trial Court. The Revision fails and dismissed accordingly. No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
