THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CIVIL MISCELLANEOUS APPEAL No.3178 OF 2004 JUDGMENT:

This Appeal was preferred against the award of the Motor Accidents Claims Tribunal, Guntur, awarding an amount of Rs.5,000/- along with interest @ 9% per annum, seeking enhancement of the compensation. The claim petition was filed seeking an amount of Rs.2,50,000/- for the injuries sustained by the appellant herein in a motor accident that occurred on 13.05.1999.

When the matter is taken up for consideration, it is noticed that the Appeal was dismissed as against the first respondent owner of the vehicle. The learned counsel for the appellant submits that though his Vakalath continued, the papers were taken away by his counterpart long back.

In the circumstances, the Civil Miscellaneous Appeal is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
