Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.
2. The petitioner was appointed as a fair price shop dealer of shop No.26 of Appasamudram Village, Udayagiri Mandal, Nellore District. While so, the authorization of the petitioner was suspended on 01.08.2015 pursuant to a report submitted by the fourth respondent on 24.07.2015. Challenging the same, the petitioner filed an appeal before the second respondent along with stay petition on 11.08.2015. The second respondent passed an order on 20.08.2015 directing the third respondent to dispose of the case pending before him within four weeks. The present writ petition is filed by the petitioner with the grievance that stating that the truth would come out, if a responsible officer is deputed to enquire into whether there is a shortage of 584 kilograms of rice or not, because the same was taken as the basis for initiation of 6-A proceedings as well as proceedings before the third respondent.
3. Since the proceedings before the third respondent are pending, this Court is not inclined to comment anything with regard to the proceedings pending before the third respondent. However, the third respondent is directed to complete the enquiry within a period of 60 days from the date of receipt of a copy of this order duly taking into account the request of the petitioner for conducting a separate enquiry with regard to the availability of the stock and shortage, if any, by giving due opportunity to the petitioner.
