THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.8450 2017 ORDER:

This criminal petition is filed under Section 482 Cr.P.C to quash the proceedings in Crime No.580 of 2017 on the file of Sanjeevareddy Nagar Police Station, Hyderabad, registered for the offences punishable under Sections 420, 468 & 471 IPC. It is contended that, more particularly, in view of the bar under Section 195(1) Cr.P.C, the Court is incompetent to investigate into the offence under Sections 468 & 471 IPC. Learned counsel for the petitioner, after arguing the matter for a while, while expressing his readiness to face the trial, if charge sheet is filed, requested this Court to direct the first respondent not to harass this petitioner and not to take coercive steps.

In view of the specific request made by the learned counsel for the petitioner, the Station House Officer, Sanjeevareddy Nagar Police Station is directed to complete investigation and file final report before the competent court, in accordance with law. The Station House Officer, Sanjeevareddy Nagar Police Station is also directed not to harass the petitioner or to take any coercive steps against the petitioner in connection with Crime No.580 of 2017 on the file of Sanjeevareddy Nagar Police Station, Hyderabad. Further, the petitioner is directed to cooperate with the Investigating Agency, enabling the Investigating Agency to file charge sheet within a month from today.

MSM,J CrlP_8450_2017 In the result, criminal petition is disposed of without touching the merits of the case.

Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
