The present writ petition came to be filed questioning the inaction of the respondents 1 and 2 in disposing the representations 07-05-2011 and 13-05-2011 made by the petitioner for conducting survey in respect of the land admeasuring Ac.08-17 guntas in survey No.68/11 in Khanapur Village, Adilabad Mandal and District. The averments in the writ petition are as under: The petitioner is the owner and possessor of Ac.08-17 guntas in survey No.68/1, Khanapur Village, Adilabad Mandal and District. Though no land is acquired in the said survey number, the respondent No.

3 and his men are entering into the land and trying to measure the land of the petitioner stating that the same falls within survey Nos 68/10 and 68/10/1 which were acquired by the Government under Land Acquisition Act for the purpose of providing house sites to weaker sections under 'Indiramma Pathakam'. As such the petitioner made representations, dated 13-05-2011 and 07-05-2011, respectively before the respondents 1 and 2 to conduct survey and demarcate the land of the petitioner admeasuring Ac.08-17 guntas in survey No.68/11. But the respondents did not act upon the same. Hence, the writ petition.

Learned Government Pleader on instructions states that the petitioner is not in possession of the land, as such the question of conducting survey does not arise. But the grievance of the petitioner is that conducting of survey is nothing to do with the possession of the property and it is false to say that the petitioner is not in possession of the land.

Without going into the merits of the case, the respondents 1 and

2 are directed to consider the representations, dated 13-05-2011 and 07-05-2011 respectively, made by the petitioner, in accordance with law, if the same are still pending within a period of six weeks from the date of receipt of copy of the order.

Accordingly, the writ petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. _________________________ JUSTICE C.PRAVEEN KUMAR 09-07-2015 Nvl
