HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.45450 of 2016 O R D E R :
The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Mandamus declaring the C.C.No.230 of 2016 under Sections 448 and 506 I.P.C. on the file of the Hon'ble XIII Metropolitan Magistrate, Ranga Reddy District, against petitioners, as illegal and arbitrary and quash the same.
Heard the learned counsel for petitioners and the learned Assistant Government Pleader for Home and perused the material available on record. On a perusal of the charge sheet, this Court is of the view that truth or otherwise of the allegations made against petitioners can be decided only after due trial. Hence, this Court is not inclined to interfere with the proceedings against petitioners.
In any event, considering the facts and circumstances of the case, the trial Court is directed to dispose of C.C.No.230 of 2016 as expeditiously as possible more preferably within a period of six months from the date of the receipt of a copy of the order.
